Terms of Service

1. General

These Terms of Service (the "Terms") govern access to skilvy.io and related services (the "Service") provided by IE Khassanov ("Company", "we"). By using the Service you ("User", "you") agree to these Terms in full. If you do not agree, do not use the Service.

We may publish additional rules for specific features; they form part of these Terms. In case of conflict, the feature-specific rules prevail for that feature.

2. Definitions

"Course" means a set of text lessons, examples and quizzes on artificial intelligence. "Content" means all Service materials. "Subscription" means recurring paid access (Pro and Ultra plans). "Account" means a User's account. "Reseller" means Paddle.com Market Ltd, the Merchant of Record.

3. Eligibility

You may use the Service if you have reached the age at which you can enter into a binding contract under applicable law (generally 18; minors only with a legal guardian's consent). By registering you confirm that your information is accurate and that you are entitled to enter into these Terms.

4. Account and security

A paid Account is required to access paid material. You are responsible for keeping your credentials secure and for all activity under your Account. Notify us immediately of any unauthorized use. We may suspend or restrict an Account if we suspect a breach of security or of these Terms.

5. Payments and Merchant of Record

Order processing is conducted by our reseller and Merchant of Record, Paddle.com Market Ltd and its affiliates (paddle.com). Paddle handles payments, invoicing and the assessment and remittance of applicable taxes. Paddle's terms and policies also apply to your purchase.

Prices are in US dollars (USD) and may exclude taxes, which are calculated at checkout based on your jurisdiction. We may change prices; changes do not affect an already-paid period.

6. Plans, subscriptions and auto-renewal

The Service offers a free plan and paid Pro and Ultra plans billed monthly or yearly. The access included with each plan is described on the pricing page and may be refined over time.

A paid Subscription renews automatically at the end of each paid period at the then-current price until you cancel. You may cancel renewal at any time; access continues until the end of the paid period. Billing and cancellation are managed through Paddle.

7. One-time course purchases

Individual Courses may be purchased once, granting ongoing access to that Course while the Service operates. A one-time purchase is not a Subscription and does not renew.

8. Refunds

Refund terms are set out in a separate Refund Policy, which forms part of these Terms. Nothing here limits your mandatory consumer rights.

9. Intellectual property

All Content, trademarks, logos, design and software of the Service are owned by the Company or lawfully licensed and protected by intellectual-property laws. No rights transfer to you except the limited license granted below.

10. License and acceptable use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Content for personal, non-commercial learning. You may not copy, download outside the interface, resell, publicly distribute, rent, share access with third parties, or create derivative products from the Content without our written consent.

11. Prohibited conduct

You must not: disrupt the Service or its security; scrape data without permission; circumvent technical limits or payment systems; impersonate others; upload malicious code; or use the Service for unlawful purposes.

12. Educational nature and disclaimers

All Content is for educational and informational purposes only. Courses on sensitive topics (health, legal, finance) do not replace professional advice and are not medical, legal or financial advice. You make decisions at your own responsibility.

13. Third-party services and AI tools

The Service may reference third-party tools (including AI assistants) and resources. We do not control them and are not responsible for their operation, terms or privacy practices. Your use of such services is governed by their own terms.

14. No warranties

The Service is provided "as is" and "as available". To the extent permitted by law, we make no warranties of uninterrupted or error-free operation, fitness for a particular purpose, or the accuracy and timeliness of the Content.

15. Limitation of liability

To the maximum extent permitted by law, the Company is not liable for indirect, incidental, punitive or consequential damages, or lost profits. The Company's aggregate liability is limited to the amount you paid for the Service in the 12 months preceding the event. These limits do not apply where liability cannot be excluded by law.

16. Indemnification

You agree to indemnify the Company against losses and costs arising from your breach of these Terms or of third-party rights.

17. Changes to the Service and Terms

We may modify, suspend or discontinue features of the Service and update these Terms. Material changes are posted on this page with an updated date. Continuing to use the Service after changes means you accept the updated Terms.

18. Suspension and termination

We may suspend or terminate access for breach of these Terms, fraud, or as required by law. You may stop using the Service at any time and delete your Account by contacting support.

19. Force majeure

The Company is not liable for failure to perform due to events beyond its reasonable control (network and hosting failures, provider actions, emergencies, etc.).

20. Governing law and disputes

These Terms are governed by the laws of Kazakhstan. The parties will seek to resolve disputes by negotiation; failing that, disputes are heard by the competent court of the relevant jurisdiction, unless mandatory consumer-protection rules provide otherwise.

21. Miscellaneous

These Terms are the entire agreement between you and the Company regarding the Service. If a provision is invalid, the rest remains in force. We may assign our rights; you may only with our consent. Failure to act on a breach is not a waiver.
